These Terms of Use ("Terms") govern your access to and use of the websites, applications and digital products (collectively, the "Services") operated by Proscaling LLC ("Proscaling", "we", "us"). By accessing or using any of our Services, you agree to be bound by these Terms.

You must be at least 18 years old to use our Services. By using the Services you represent that you meet this requirement and that any information you provide is accurate.
Some of our Services are offered on a paid subscription basis. Orders and payments are processed by our authorized merchant of record. When you purchase a subscription, your contract of sale is with the merchant of record, which handles payment processing, invoicing, applicable taxes and customer payment queries. The identity of the merchant of record is always displayed at checkout. Subscription terms, prices and renewal conditions are always displayed at the point of purchase before you pay.
Subscriptions are further governed by our Subscription Terms. Unless stated otherwise at checkout, subscriptions renew automatically at the end of each billing period at the then-current price until cancelled. You can cancel at any time from your account settings or by contacting proscalingllc@gmail.com; cancellation takes effect at the end of the current billing period.
Refunds are governed by our Refund Policy, which forms part of these Terms.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.
You agree not to misuse the Services, including by: attempting to access them by unauthorized means; interfering with their normal operation; reverse-engineering, scraping or reselling them; or using them for any unlawful purpose.
Our wellness products provide general wellbeing content and are not a substitute for professional medical advice, diagnosis or treatment. Always consult a qualified health provider with questions regarding a medical condition. Never disregard professional advice because of something you read or used in our Services.
All content, software, trademarks and materials in the Services are owned by or licensed to Proscaling LLC and are protected by applicable intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable license to use the Services for their intended purpose.
The Services are provided "as is" and "as available" without warranties of any kind, express or implied, to the maximum extent permitted by law.
To the maximum extent permitted by law, Proscaling LLC shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or data, arising from your use of the Services. Our aggregate liability shall not exceed the amounts you paid for the Service in the twelve months preceding the claim.
We may update these Terms from time to time. Material changes will be notified through the Services or by email. Continued use after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the United States and the State of Florida, without regard to conflict-of-law principles.
